By using the services of Pojo Technology, you agree to the following terms and conditions.
The features and functionalities outlined in the approved scope of work shall be developed and implemented exclusively on the website and the admin panel application (if admin panel is applicable). No additional platforms or modules shall be included unless mutually agreed. Pojo Technology shall provide necessary training to the Client’s authorized personnel to facilitate proper understanding and effective utilization of the delivered product.
This proposal and the pricing contained herein are valid for a period of 10 days from the date of issue. After the expiry of this period, Pojo Technology reserves the right to revise, amend, or withdraw the proposal, including pricing, scope, and terms, without prior notice. Any acceptance received after the validity period shall be subject to reconfirmation and approval by Pojo Technology.
Pojo Technology’s official working hours are from 9:30 AM to 6:30 PM (IST) on business working days. All project communication, technical support, development activities, issue resolution, approvals, and coordination shall be handled only during official working hours. Any calls, meetings, support requests, emergency assistance, or project discussions requested outside official working hours, on weekends, or on public holidays shall be subject to availability and may incur additional support or emergency service charges at the sole discretion of Pojo Technology.
The client is solely responsible for collecting, storing, and processing end-user data such as Mail, WhatsApp, Call and Other Enquires, Call in compliance with applicable laws. Pojo Technology acts only as a technical service provider. The client must ensure privacy policy compliance on their platform.
All source code, designs, UI/UX, architecture, and development frameworks remain the property of Pojo Technology until full payment is received. Upon full payment, the client receives usage rights as per agreement but not source code ownership
The client is solely responsible for ensuring compliance with applicable data protection laws, including the IT Act 2000 and related rules. Pojo Technology acts only as a technical service provider and is not responsible for misuse of collected user data. The client must publish and maintain a valid Privacy Policy on their platform.
Pojo Technology’s total liability shall not exceed the total amount paid for the project. The company shall not be liable for indirect, incidental, or consequential damages including loss of profit, data, or business.
The client agrees to indemnify and hold harmless Pojo Technology from any claims, penalties, or legal actions arising from:
Illegal content, phishing, fraud, financial scams, impersonation, fake job postings, illegal downloads, trademark misuse, copyright violations, misuse of photos, logos, mobile numbers, addresses, electronic signatures, passwords, personal information, any other organization’s confidential data, adult content, misuse of the platform or any unlawful activities. You accept full legal responsibility for the all content in websites, data, activities, and usages.
Pojo Technology shall not be liable for delays or failure due to events beyond its control, including natural disasters, hacking, cyber-attacks, government restrictions, internet failure, etc.
Pojo Technology shall not be liable to any third party for whom the project is developed unless a separate written agreement is executed directly between Pojo Technology and such third party. Pojo Technology shall be considered only as a technical service provider to the Client and shall have no direct contractual relationship, liability, or responsibility toward the Client’s end customer or any other third party. Any claims, disputes, legal notices, or liabilities arising from the end customer or third parties shall be the sole responsibility of the Client. The Client agrees to indemnify and hold harmless Pojo Technology from any such claims or legal actions.
Pojo Technology does not guarantee uninterrupted or error-free service. Service performance may depend on third-party providers like hosting companies, payment gateways, SMS providers, E-mail services etc.
In case of delayed payments, Pojo Technology reserves the right to suspend services without prior notice.
Pojo Technology reserves the right to terminate services if the client engages in unlawful, unethical, or harmful activities.
The Client shall be solely responsible for providing, uploading, and maintaining all product-related data within the system. Pojo Technology shall not be liable for data entry, data accuracy, or ongoing content management unless expressly included in the agreed scope of work under a separate written agreement.
Domain registration and renewal shall be the sole responsibility of the Client. Pojo Technology shall not be liable for any loss, suspension, or interruption of services arising from failure to renew the domain in a timely manner.
Any request for changes, enhancements, or additional features beyond the finalized scope of work shall be treated as a separate change request. Such requests shall be subject to feasibility analysis, mutual written approval, revised timelines, and applicable additional charges. No additional work shall commence without written confirmation from both parties.
All advance payments made upon confirmation of the project are strictly non-refundable under any circumstances. This includes project cancellation, delay, or change of decision by the client after commencement of work.
Pojo Technology shall provide one (1) month of complimentary support and maintenance from the date of successful project delivery. This support covers bug fixes and minor technical issues only. Any enhancements, feature additions, or modifications beyond the original scope of work shall be subject to additional charges.
If the proposed product or service requires integration with Google Maps, Pojo Technology will provide a Google Maps API key during project delivery for initial usage. The free usage limits provided by Google are subject to Google's policies and may change from time to time. In the event that the application's Google Maps API usage exceeds the free quota allocated by Google, any additional charges incurred shall be the responsibility of the client. The client may be required to create and maintain their own Google Cloud billing account and API key for continued uninterrupted service.
As part of the package, Pojo Technology may provide webmail email accounts associated with the client's domain name (e.g., info@yourdomain.com). The provided email service is a basic webmail service and is not Google Workspace (Gmail), Microsoft 365, or any other third-party premium email service. If the client requires Google Workspace (Gmail for Business), Microsoft 365, or any other premium email solution, the corresponding subscription, licensing, setup, and renewal charges shall be borne separately by the client.
Pojo Technology may assist in setting up webmail services associated with the client's domain. Such webmail services are provided by third-party hosting or email service providers and are not operated, owned, or managed by Pojo Technology. The client acknowledges that service interruptions, downtime, delivery delays, spam filtering issues, storage limitations, or other email-related issues may occur from time to time. While Pojo Technology will provide reasonable assistance and coordination to help identify and resolve such issues, Pojo Technology shall not be held responsible for any disruption, data loss, or performance issues arising from the third-party email service provider.
Pojo Technology utilizes third-party hosting providers for server and database services and does not operate or own its own hosting infrastructure. Any downtime, data loss, technical malfunction, or service disruption caused by the hosting provider shall not be the liability of Pojo Technology. The Client acknowledges that hosting performance is subject to the terms and policies of the respective third-party provider. Pojo Technology shall provide necessary technical support and coordination to assist in resolving such issues but shall not be held financially or legally responsible for failures beyond its control.
Any third-party services, including payment gateways, SMS gateways, hosting providers, or external APIs, are governed by their respective service providers. Pojo Technology shall not be liable for any downtime, transaction failures, policy changes, technical errors, delayed settlements, chargebacks, banking downtime, UPI issues, payment fraud, or gateway holds or service interruptions caused by such third-party providers.
The annual renewal amount may increase depending on storage requirements and server usage. Charges for hosting, maintenance, and support may also be revised based on database storage consumption and overall server utilization. Hosting server and database services must be renewed annually.
Annual renewal charges must be paid on or before the due date to ensure uninterrupted service. Annual renewal charges shall be applicable for hosting, server usage, maintenance, database services, technical support, security updates, and related service infrastructure. Renewal charges will be calculated based on the total project scope, storage utilization, bandwidth consumption, database size, server resources, and ongoing maintenance requirements. The Client acknowledges and agrees that renewal charges may increase from time to time depending on increased storage requirements, server resource utilization, third-party service charges, infrastructure upgrades, and maintenance overheads. Hosting server services, domain-related services (if applicable), and database services must be renewed annually without interruption to ensure continuous availability of the website/software/application. In the event the Client fails to renew the services within the renewal due date, or fails to provide prior written intimation regarding renewal continuation, Pojo Technology reserves the full right to suspend, disable, or permanently remove the project, database, files, emails, backups, hosting resources, and associated services from the server without any further liability, responsibility, compensation, or prior notice to the Client. Pojo Technology shall not be held responsible for any data loss, business interruption, revenue loss, downtime, deletion of backups, email loss, or operational impact arising due to non-renewal, delayed renewal, or failure of payment by the Client.
Pojo Technology acts solely as an intermediary service provider between the Hosting Service Provider and the Client. We facilitate domain registration, hosting purchase, and technical setup based on the client’s instructions. We do not own, control, or operate the hosting infrastructure.
As per Section 79 of the Information Technology Act, 2000 (Intermediary Liability), Pojo Technology shall not be held responsible or liable for:
Any unlawful, infringing, defamatory, misleading, or illegal content uploaded by the client. Any violation of intellectual property rights, data protection laws, or third-party rights arising from client-provided materials. Any disputes arising between the Client and third parties regarding website content.
The website/mobile application is hosted on third-party hosting servers/ play store / app store. Pojo Technology shall not be liable for Server downtime, Data loss, Security breaches, technical failures caused by the Service Provider
The Client agrees to indemnify, defend, and hold harmless Pojo Technology, its directors, employees, agents, and representatives from and against any and all claims, demands, losses, damages, liabilities, penalties, fines, legal proceedings, legal expenses (including advocate fees), or financial costs arising out of or related to:
In the event that Pojo Technology suffers any financial loss, penalty, legal notice, tax liability, regulatory action, reputational damage, or other direct or indirect loss due to the Client’s actions, omissions, negligence, misconduct, or client dealings, the Client shall fully compensate and reimburse Pojo Technology for such losses without delay upon written demand.

Approval of this quotation, issuance of a purchase order, or payment of any advance amount shall constitute full and unconditional acceptance of the above Terms and Conditions, forming a legally binding agreement between the Client and Pojo Technology.
The payment schedule and milestones shall be defined in the project agreement and shall be strictly adhered to by the client. In the event of delayed or non-payment, Pojo Technology reserves the right to suspend ongoing work, disable access to services, or withhold deliverables until all outstanding dues are fully settled. Any delay in payment may also result in revised project timelines and cost.
Unless specifically agreed in writing, Pojo Technology shall not be responsible for periodic data backups. The client is responsible for maintaining necessary backups of business-critical data.
The client is responsible for implementing appropriate security measures such as strong passwords, access controls, and internal data protection practices. Pojo Technology shall not be liable for data breaches resulting from weak security practices or unauthorized access by the client.
All data, content, and materials used on the website or application during development, including but not limited to logos, images, text, documents, and credentials, shall be provided by the Client with full knowledge, authorization, and consent. The client confirms that it has the necessary rights and permissions to use such materials.
Pojo Technology shall not be liable for any vulnerabilities, losses, or damages arising from client misconduct, misuse of the system, or unauthorized modifications. The company shall also not be responsible for issues caused by natural disasters, hacking incidents, virus attacks, or hardware/software failures beyond its reasonable control.
During the course of development, Pojo Technology may require access credentials such as email accounts, social media accounts & credentials, hosting access, admin panel login, domain credentials, server credentials, database credentials, business email accounts, API keys, payment gateway credentials, SMS/OTP gateway credentials, credit / debit card credentials, person logins, or any other related login details. Such credentials shall be shared by the client with full knowledge, authorization, and consent. The client acknowledges that it is their responsibility to provide accurate credentials and to update or change passwords after project completion if deemed necessary.
Pojo Technology does not create, own, manage, or take responsibility for client accounts on third-party platforms such as Instagram, Facebook, WhatsApp, YouTube, LinkedIn, X (Twitter), email services, or any other social media or communication platforms unless explicitly agreed upon in writing. The client is solely responsible for creating and maintaining such accounts and for providing the necessary links, access permissions, or credentials required for integration purposes. Pojo Technology’s responsibility is limited only to integrating or linking the client-provided accounts, URLs, or contact details within the website, application, or related services.
Upon project confirmation, Pojo Technology may create a dedicated WhatsApp group including the client and relevant project team members for the purpose of project coordination, communication, updates, approvals, support, and development-related discussions. All project-related information, including progress updates, design approvals, requirement clarifications, testing status, deployment details, and support communication may be shared through the WhatsApp group for operational convenience and faster communication.

If the client purchases the domain through Pojo Technology, a standard SSL certificate may be provided free of cost, subject to availability and the terms of the respective service provider. If the client already owns a domain purchased from another provider, the client may be required to obtain an SSL certificate from their existing domain or hosting service provider. Alternatively, Pojo Technology can assist in purchasing and installing the SSL certificate upon request, and applicable charges will be communicated based on the selected SSL plan and service requirements.
Pojo Technology may provide dynamic bandwidth allocation based on the selected hosting package, server capacity, and normal business usage requirements. Bandwidth availability may vary depending on traffic volume, server performance, resource consumption, and third-party hosting provider policies. Pojo Technology reserves the right to manage, limit, upgrade, or optimize bandwidth usage whenever necessary to maintain server stability, security, service quality, and fair resource distribution among clients. Additional charges may apply for excessive usage, high-traffic consumption, or upgraded bandwidth requirements beyond the standard allocated resources.
The term “30-Minute Delivery” refers to the estimated time required for the website to become accessible online once the client’s domain DNS settings are correctly updated and successfully propagated to Pojo Technology’s server. After successful DNS configuration and propagation, the developed website is generally expected to be deployed and accessible on the internet within approximately 30 minutes. However, actual delivery time may vary depending on DNS propagation delays, server response time, third-party provider processing, technical limitations, or other unforeseen external factors beyond Pojo Technology’s control.
Certain packages provided by Pojo Technology may include business email services offered through third-party hosting or server providers. Such email services are dependent on the infrastructure, uptime, and technical support of the respective hosting provider. In the event of service interruptions, downtime, delivery delays, spam-related issues, server-side restrictions, or other technical email-related problems, Pojo Technology may provide reasonable technical assistance and coordination with the respective hosting or server provider to help resolve the issue. However, Pojo Technology does not guarantee uninterrupted email service availability and shall not be held liable for outages, data loss, delayed email delivery, or technical failures caused by third-party service providers or external technical factors beyond its control.
If the Client fails to provide required approvals, feedback, content, documents, credentials, confirmations, or other necessary information within the requested timeframe, the project timeline shall automatically be extended accordingly. The Company shall not be held responsible for any delay in project completion caused directly or indirectly by the Client’s inaction, delayed response, change requests, unavailability, or failure to cooperate during the development process. The Client acknowledges and agrees that project completion dates are tentative estimates and may be revised based on project requirements, dependency delays, third-party service issues, or pending approvals from the Client. Any adjustment, extension, or rescheduling of the project delivery timeline due to such circumstances shall be deemed accepted by the Client. The Company reserves the right to revise milestones, delivery schedules, deployment dates, support periods, and handover timelines without liability where delays arise from Client-side dependencies. Additional server charges, hosting fees, maintenance costs, manpower costs, subscription renewals, or infrastructure expenses incurred due to prolonged project duration caused by Client delays may be charged separately to the Client. The Client further agrees that no refund, compensation, penalty, legal claim, or liability shall arise against the Company for timeline extensions resulting from delayed communication, incomplete requirements, repeated modifications, or non-availability of the Client for approvals/testing.
The Client acknowledges and agrees that full administrative access, control permissions, and operational authority over the admin panel, dashboard, users, content, settings, files, and system management features may be provided to the Client and/or the Client’s authorized staff. Once such access is granted, Pojo Technology shall not be held responsible or liable for any accidental or intentional deletion, modification, corruption, overwrite, misuse, unauthorized changes, misconfiguration, suspension, or loss of users, customer records, bookings, files, transactions, reports, databases, settings, website content, application data, or any other information caused directly or indirectly by the Client, the Client’s employees, third-party vendors, or any person accessing the admin panel using the Client’s credentials. The Client shall bear sole responsibility for maintaining proper access control, password security, backup management, employee authorization, and operational handling of the admin panel. Any data loss, operational interruption, business loss, system malfunction, or financial impact resulting from actions performed through the admin access shall be entirely at the Client’s own risk. Pojo Technology shall not be liable for restoring deleted data unless a separate paid backup, maintenance, or recovery agreement is explicitly agreed upon in writing.
The Client acknowledges that timely completion of the project depends upon providing required content, approvals, credentials, feedback, confirmations, documents, and communications within the agreed timelines. In the event the client fails to respond, communicate, provide required materials, or remain inactive or unengaged in the project. Pojo Technology shall not be held responsible for any delay in project delivery arising due to:

The Client further agrees that all payments made towards development, consultation, server usage, domain registration, hosting services, third-party integrations, licenses, manpower allocation, and completed work shall be treated as non-refundable. The Company shall not be held responsible for any delay, data loss, business loss, deployment delay, ranking issues, campaign interruption, or operational impact arising due to the client’s non-responsiveness, delayed approvals, or failure to provide required inputs within the stipulated timeframe. Any additional work, revisions, modifications, or delays beyond the originally agreed scope and timeline may result in revised delivery schedules and additional commercial charges.
The Software/Application provided by Pojo Technology is offered strictly on a Software-as-a-Service (SaaS) model. The Client acknowledges and agrees that the application, server infrastructure, hosting environment, source code, APIs, databases, deployment architecture, configurations, and related intellectual property shall remain the sole and exclusive property of Pojo Technology unless otherwise agreed through a separate written agreement signed by both parties.
Pojo Technology shall not provide:
to the Client under normal SaaS subscription/service arrangements. Any request for transfer of ownership, source code handover, database export, hosting migration, server credentials, or infrastructure access shall be considered only upon execution of a separate written agreement, additional commercial settlement, and formal approval by Pojo Technology.
The Client further agrees that payment for development, subscription, customization, maintenance, or hosting services does not constitute ownership transfer of the software, source code, infrastructure, or underlying technology.
In the event of any dispute, claim, disagreement, legal proceeding, recovery action, complaint, arbitration, consumer case, or litigation arising out of or relating to the services, software, website, mobile application, admin panel, hosting services, agreements, invoices, payments, transactions, or business dealings with Pojo Technology, the Client expressly agrees that such matters shall be subject exclusively to the jurisdiction of the competent courts located in Chennai only.
The Client further agrees that:
The Client acknowledges that acceptance of quotation, payment of advance, project confirmation, invoice approval, use of services, access to software, or continued business engagement with Pojo Technology shall constitute full acceptance of this jurisdiction clause and shall be legally binding upon the Client.
In certain cases, the domain name may initially be purchased, registered, or managed under the account of Pojo Technology for project setup, development, or temporary management purposes and later transferred to the Client’s ownership or registrar account upon request. The Client acknowledges and agrees that after the domain transfer process is initiated or completed, the domain may temporarily enter suspension, hold, verification pending, registrar lock, ICANN hold, DNS interruption, or restricted status due to email verification requirements, registrar policies, KYC validation, non-response to verification emails, incorrect registrant information, third-party registrar actions, or compliance-related procedures. Pojo Technology shall not be held responsible or liable for any domain suspension, hold status, DNS propagation issue, email verification failure, service interruption, website downtime, email downtime, or loss of access occurring after or during the domain transfer process. It shall be the sole responsibility of the Client to complete all required email verifications, registrar confirmations, identity validations, and compliance procedures within the stipulated timeframe provided by the domain registrar or governing authority. Any delays, losses, business interruptions, SEO impact, email failures, or temporary unavailability arising from such domain verification or transfer-related issues shall not create any legal, financial, or operational liability upon Pojo Technology.
The Client acknowledges and agrees that any domain registered by Pojo Technology on behalf of the Client may initially be maintained temporarily under Pojo Technology’s registrar account or management account for operational, technical, billing, verification, or deployment purposes. However, the ownership rights of such domain shall always belong solely to the Client, subject to successful payment clearance and compliance with applicable domain policies. Pojo Technology reserves the right to transfer the domain to the Client’s own registrar account at any time upon request or as per operational requirements. The Client further agrees that any legal dispute, trademark issue, copyright claim, naming conflict, government complaint, misuse, illegal activity, or third-party claim arising in connection with the domain name, website content, business operations, or activities conducted through the domain shall be the sole responsibility of the Client. Pojo Technology shall not be held liable or responsible for any such disputes, claims, losses, penalties, or legal consequences arising from the use of the domain.
By approving the quotation, issuing a purchase order, confirming the project through written communication, replying to the email, or making any advance payment, the client agrees to be bound by these Terms and Conditions. Such acceptance shall constitute a legally binding agreement between the Client and Pojo Technology and shall be governed in accordance with the laws of India, including the Information Technology Act, 2000, and any applicable amendments or related regulations.
